Ghana to Implement Cabotage Law to Protect Domestic Shipping Industry

Ghana is gearing up to fully implement the Ghana Shipping Regulations, 2021 LI 2438, also known as the Cabotage Law, in order to regulate and safeguard the domestic shipping industry from foreign competition. This move is aimed at domesticating certain shipping activities within the maritime and shipping sectors of Ghana.

Mr. George Anti-Kwakye, a Principal Maritime Administrative Officer at the Ghana Maritime Authority (GMA), made this announcement at a media forum organized by the Ghana Ports and Harbours Authority (GPHA). He highlighted that the law mandates that 50 percent of officers and 75 percent of ratings working on vessels operating in Ghana’s waters must be of Ghanaian nationality.

Furthermore, the Cabotage Law presents an opportunity for unemployed Ghanaian seafarers to gain valuable sea time while facilitating skills transfer in areas where Ghanaian seafarers are looking to enhance their expertise.

The law will cover various types of vessels including oil tankers, offshore support vessels, passenger vessels, fishing vessels, and merchant ships, among others. However, naval vessels and government vessels are exempt from its provisions.

Mr. Anti-Kwakye emphasized that under the Cabotage Law, Ghanaian seafarers will receive equal remuneration to their foreign counterparts holding the same rank and performing similar responsibilities aboard ships. To ensure a smooth implementation, consultations have been ongoing with shipping companies, seafarer recruitment agencies, maritime training institutions, and other relevant stakeholders.

An enforcement team has been established by the Ghana Maritime Authority to ensure compliance with the regulations, with fines and penalties in place for non-compliance. The aim is to gradually phase out foreign seafarers in favor of Ghanaian seafarers who will eventually take over key roles within the industry.

Overall, the Cabotage Law is expected to not only protect Ghana’s maritime industry but also promote the growth and development of local talent within the sector.
